PROCEEDINGS
:
(1) Based on the 12(3) settlement dt.10.08.07, signed before the Commissioner of
Labour, the TNEB issued orders for revival of the post of Mazdoor and for
absorption of contract labourers who have worked continuously in Distribution
Circles, General Construction Circles and Wind Energy Development Circles as
Mazdoor, Helper cum Meter Reader and Assessor Grade - II in a phased manner
vide reference (2) read above. As per these
orders, the contract labourers whose qualification was below 10th
standard and 'nil' qualification have been appointed to the post of Mazdoor.
(2) Further,
based on the various demands from the unions, TANGEDCO considered the promotion
of the Mazdoors in its 22nd Board meeting held on 06.03.12 and
approved the proposal for the relaxation of rules relating to qualification of
NTC/ NAC for promotion to the post of Helper in a phased manner and accordingly
6,593 Mazdoors were promoted as Helper (Field Assistant) in the first phase and
4,660 Mazdoors were promoted as Helpers (Field Assistant) in the second phase vide
references (8) and (9) read above.
(3) Now, based on the unions’ demands, the
TANGEDCO hereby directs that the remaining 5,906 Mazdoors absorbed as per the
12(3) settlement [4,128 absorbed during 2009 and 1,778 absorbed during 2010] during
the period 02.06.2010 to 24.02.2011 as mentioned in the Annexure – I shall be
promoted as Helper (Field Assistant) in the time scale of pay of Rs.5,400 - 20,200
+ 1,900 G.P., if they are or otherwise suitable, subject to the
outcome of the Writ Petition No. 13015 of 2013 pending before the Hon’ble High
Court of Madras. Consequent on promotion of the above Mazdoors the post of 5,906
Mazdoors shall be abolished.

(4) The Superintending Engineers are further
informed that the promotion of the Mazdoors as Helpers (Field Assistant) are to
be issued immediately and accommodated against the existing vacancies of
Helpers (Field Assistant) and Helper / Wireman posts. Any excess promotees may
be accommodated in their circle itself as Supernumerary which will be abolished
subsequently as and when the incumbent are promoted or vacates the post on
transfer, retirement or death etc..
(5) Further the Superintending Engineers are
informed to adhere to the following points while issuing orders to the above
Mazdoors as Helpers :

(i)

The
Mazdoors who are not willing for promotion as Helpers may be permitted to
relinquish their rights for promotion (Temporary or Permanent) and continued in
service as Mazdoors till their age of 60 years.

(ii)
|
The
Mazdoors who have completed 58 years of age need not be promoted as Helper
rather they should continue as Mazdoor up to the age of 60 years.
|
|
|
|
|
(iii)
|
That
no reversion shall be accepted to the old post of Mazdoor if the promotees
have joined as Helper.
|
(6) The receipt of this B.P. should be
acknowledged.

The Superintending
Engineers (As per the Annexure – I) :
(i) The Superintending Engineers are requested to
issue promotion and posting orders to the 5906 Mazdoors. Any discrepancies
regarding identity, eligibility and Disciplinary Proceedings against the above
Mazdoors may be got clarified from this office before issuing the order to the
concerned individual.
(ii) A
consolidated statement of the Mazdoors promoted as Helpers may be furnished to
the regional Chief Engineers as stated in the Annexure – II for further action
without fail.
