இறந்த ஊழியரின் சகோதரருக்கு கருணைப் பணி வழங்க உத்தரவு

மின்வாரிய ஊழியர் இறந்ததால், கருணை அடிப்படையில் அவரது சகோதரருக்கு பணி வழங்குமாறு, சென்னை உயர் நீதிமன்ற மதுரைக் கிளை உத்தரவிட்டுள்ளது.

1. மதுரை மாவட்டத்தைச் சேர்ந்த பி. பாண்டிசெல்வம் என்பவர் தாக்கல் செய்த மனு விவரம்: எனது அண்ணன் பி. பாலகிருஷ்ணன் மின்வாரியத்தில் வயர் மேனாக பணியாற்றினார். அவருக்கு திருமணமாகவில்லை. 2004-ஆம் ஆண்டு பணியில் இருந்தபோது இறந்துவிட்டார். அவருக்கு நேரடி வாரிசுகள் இல்லாத நிலையில், எனக்கு கருணை அடிப்படையில் பணி வழங்கக் கோரி 2007 ஜூலை 30-இல் விண்ணப்பித்தேன். எனது விண்ணப்பத்தை, மதுரை பெருநகர் மின்பகிர்மான கண்காணிப்புப் பொறியாளர் 2007 ஆகஸ்ட் 14-இல் நிராகரித்தார்.

எனவே, எனது மனுவை பரிசீலித்து பணி வழங்க உத்தரவிட வேண்டும் என குறிப்பிட்டிருந்தார்.

இம்மனுவுக்கு மின்வாரியம் அளித்த பதிலில், திருமணமாகாத சகோதரர் அல்லது சகோதரிக்கு கருணை அடிப்படையில் பணி வழங்கலாம் என்ற அரசு உத்தரவை, மின்வாரியம் 2008 ஆகஸ்ட் 18-இல் இருந்துதான் செயல்படுத்தி வருகிறது. எனவே, அதற்கு முன்பு உயிரிழந்த ஊழியரின் சகோதரருக்கு பணி வழங்க இயலாது என தெரிவித்தது.

மனுவை விசாரித்த நீதிபதி வி.எம். வேலுமணி பிறப்பித்த உத்தரவு:

கருணை அடிப்படையிலான பணி தொடர்பான அரசு உத்தரவு 1998-இல் வெளியாகியுள்ளது. மனுதாரரின் சகோதரர் 2004-இல் இறந்தார். 2007-இல் கருணை அடிப்படையிலான பணி கோரி மனுதாரர் விண்ணப்பித்துள்ளார். இந்நிலையில், அரசு உத்தரவை 2008-ஆம் ஆண்டில்தான் அமல்படுத்தியுள்ளதாகக் கூறி, மனுதாரருக்கு பணி வழங்க மின்வாரியம் மறுத்துள்ளது.

மனுதாரர் திருமணமாகாதவர் என்பதையும், அவருக்கு பணியாற்ற தகுதி இருப்பதையும் மின்வாரியம் மறுக்கவில்லை. மேலும், மனுதாரர் வசதியாக வாழ்பவர் எனவும் கூறவில்லை. மனுதாரர்தான் இறந்தவருக்கு ஒரே வாரிசாக உள்ளார். எனவே, மனுதாரரின் மனுவை மீண்டும் பரிசீலித்து, 8 வாரங்களில் மின்வாரியம் முடிவு செய்யவேண்டும். இந்த உத்தரவை மற்ற வழக்குகளில் முன் உதாரணமாக எடுத்துக் கொள்ளக்கூடாது என உத்தரவில் குறிப்பிட்டார்.
